Of course they'll realise eventually so you should either report it or do nothing, definately not spend the money because when they realise they will want it back and it will be legally theirs and actually, come ot think of it, you should report it because you'd be in a lot of trouble when they found out if you hadn't told them.

I would report it but he is opting to do nothing at the moment and pretends he is the type of person who doesnt check his bank statements.

Our HR manager was saying the onus would be on the company to find out if they had made any overpayments. Its not a sackable offence but the company would probably find another reason to sack him later.

You are legally obliged to pay it back... there have been cases in Scotland where people haven't bothered telling and spent the money eventually getting into all sorts of trouble with the law.

They WILL find out tho and if you have spent the money and can't pay it back you can be charged with theft.

If you tell them then the company this person works for will see them as a honest person and would trust them more.
