They give people a licence to broadcast publically. I am a Radio DJ and we are looking into Off Com to give us a licence to go On-Air to people.

Therefore makes it legal.

Offcom only give you the license for an FM/AM/DAB frequency, and the right to broadcast on it. And even then you still need to PRS and all that.

But Offcom don't govern the internet. So for broadcasting legally on the net you need to go through MCPS/PRS/PPL... Offcom have got bugger all to do with net radio.
